TERMS AND CONDITIONS

“Client” hereinafter refers to the person responsible for payment and/or who will be receiving services.

During the term of the agreement, 12 weeks (as established by Darius and Client), Darius will provide the following services…

INCLUSIONS:

⭐️ 90-minute private coaching session every week for 12 weeks
⭐️ Text/SMS access to Darius (Mon-Fri, 10am-4pm ET)
⭐️ Weekly guided meditation & visualization (custom for this program)
⭐️ Failure reprogramming: A fun, creative assignment each week designed to grow your confidence, resilience, and consistency

Client acknowledges and understands:
(1) that Darius is not a licensed therapist, and Client cannot bill his/her insurance for services rendered pursuant to this Agreement;

(2) Darius does not provide diagnoses of any health or mental disorders;

(3) Darius does not offer any guarantees of results in connection with the Coaching Services provided.

CLIENT RESPONSIBILITIES AND CANCELLATION POLICY

Weekly meeting times will be set by Darius and Client at the beginning of their time together. Client is responsible for timely communication with Darius regarding scheduling conflicts.

While Darius will do his best to accommodate schedule requests, Client must provide twenty-four (24) hour notice of cancellations or schedule change requests.

Client acknowledges and understands that there is no refund or reschedule for cancellations made with less than twenty-four (24) hours advance notice.

PAYMENT

Client agrees to complete their payments within the term of the agreement (12 weeks) or services will be halted.

If an individual wishes to terminate their coaching package, they must first have a Zoom conversation with Darius. When that is complete, he will stop any future payments OR refund the client on a prorated basis.

TERM AND TERMINATION

Clients agree that all coaching services must be used within the 12 weeks allotted, or otherwise be forfeited.

Any sessions canceled with advanced notice of at least 24 hours, given by either party, may be rescheduled to the end of this agreement - if they cannot be rescheduled within the original week.

CONFIDENTIALITY

Client acknowledges and understands that no confidential relationship exists between Darius and Client. While Darius is committed to treating Client’s information with the highest level of integrity, and will protect all of Client’s sensitive information, there is no legal protection given to Client and Darius’s relationship under this Agreement or otherwise.

GOVERNING LAW

This Agreement will be governed by and construed following the laws of Ontario, Canada, without regard to conflict-of-law principles.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement and understanding of the parties concerning the subject matter of this Agreement and supersedes all prior understandings and agreements, whether written or oral, among the parties concerning such subject matter.

SEVERABILITY

If any provision of this Agreement is deemed invalid or unenforceable, in any respect for any reason, the validity and enforceability of such provision in any other respect and of the remaining provisions of this Agreement will not be impaired in any way.
